1. Acceptance of Terms
Welcome to Mikeka AI ("the Platform"). These Terms and Conditions ("Terms") govern your use of our platform, which provides AI-driven betting predictions for both real and virtual sporting events. By accessing or using the Mikeka AI platform, you signify your agreement to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
Mikeka AI reserves the right to modify these Terms at any time. We will notify users of any significant changes, but it is your responsibility to review these Terms periodically. Continued use of the Platform after such modifications constitutes your acceptance of the new Terms.
2. Nature of Service
2.1. Mikeka AI is a sports advisory platform that utilizes proprietary AI algorithms to generate betting predictions. These predictions are based on data obtained from publicly available sources.
2.2. The Platform sells these predictions to users in the form of "tickets." Users may purchase multiple tickets for various predictions. The purchase of a ticket grants the user access to specific prediction(s) as offered by the Platform.
2.3. Mikeka AI is NOT a betting or gambling operator. We do not accept bets, manage wagers, or facilitate gambling activities. Our service is strictly advisory, aimed at providing insights to enhance your understanding and potential success in sports betting through third-party betting operators.
2.4. Users may purchase tickets for immediate access to predictions or for later selection, akin to a deposit system for acquiring prediction access. However, funds used to purchase tickets are non-refundable and cannot be withdrawn, as they represent payment for access to our advisory content and AI-generated predictions.
3. No Guarantee of Winnings
3.1. While Mikeka AI employs advanced AI algorithms and analyzes data from public sources to generate predictions, we offer NO GUARANTEE OF WINNINGS. Sports events are inherently unpredictable, and past performance or algorithmic analysis does not assure future success.
3.2. Our predictions are intended to increase the favor of winnings for our customers by providing informed insights. However, all betting decisions made by users based on our predictions are made at their own sole risk and discretion. Mikeka AI shall not be liable for any financial losses or damages incurred as a result of using our predictions.
4. User Accounts and Responsibilities
4.1. To access certain features of the Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
4.2. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4.3. You must be of legal age in your jurisdiction to use betting advisory services and to engage in betting activities with third-party operators.
5. Intellectual Property Rights
5.1. All content, predictions, AI algorithms, software, designs, text, graphics, logos, and other materials provided on the Mikeka AI Platform are the exclusive property of Mikeka AI and its licensors. This includes the "Mikeka AI" name and associated branding.
5.2. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform and its predictions for your personal, non-commercial use only, subject to these Terms.
5.3. You are strictly prohibited from copying, reproducing, modifying, distributing, transmitting, displaying, performing, publishing, or creating derivative works from any part of the Platform or its content, including the predictions, without the express prior written consent of Mikeka AI. Unauthorized redistribution or replication of our predictions or proprietary information will result in immediate termination of your access and may lead to legal action.
6. Prohibited Conduct
You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Platform. Prohibited conduct includes, but is not limited to:
- Attempting to gain unauthorized access to the Platform or its systems.
- Using any automated means (e.g., bots, scrapers) to access or collect data from the Platform.
- Sharing your purchased prediction tickets or account access with unauthorized third parties.
- Misrepresenting your identity or affiliation with any person or entity.
- Violating any applicable local, national, or international law or regulation.
7. Data Sources and Accuracy
Mikeka AI utilizes data from publicly available sources for its AI algorithms. While we strive for accuracy in data collection and processing, we do not warrant the completeness, reliability, or accuracy of this third-party data. Predictions are generated based on the data available at the time of analysis and may be subject to change.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Mikeka AI, its affiliates, officers, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content or predictions obtained from the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
9. Indemnification
You agree to defend, indemnify, and hold harmless Mikeka AI and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Platform, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Platform.
10. Termination
Mikeka AI may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.
11. Governing Law & Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the United Republic of Tanzania, without regard to its conflict of law provisions. You agree to submit to the non-exclusive jurisdiction of the courts located in Tanzania for the resolution of any disputes arising out of or relating to these Terms or the Platform.

Kijiwe Plus Chat Policy
This policy outlines the rules and guidelines for using the "Kijiwe Plus" chat feature within the Mikeka AI platform. By using Kijiwe Plus, you agree to abide by these policies in addition to the main Mikeka AI Platform Terms and Conditions.
13. Privacy of Private Chats
Data exchanged within private (one-on-one) chats is intended solely for communication between the two participants. Mikeka AI will not access or read the content of private chats unless deemed strictly necessary for operational, security, or legal compliance reasons, as permitted by applicable law. Under no circumstances will the content of your private chats be shared with any external third parties outside of our direct operational jurisdiction, unless legally compelled.
14. Group Chat Functionality
Any individual user may create a new chat group on Kijiwe Plus. Users cannot be added directly to a group by another member. You can only join a group if you receive an invitation and explicitly accept it. You are free to leave any group chat at any time.
15. User Conduct and Content
Users are responsible for all content they share on Kijiwe Plus. Prohibited content and conduct include, but are not limited to: foul language, spamming, harassment, discrimination, hate speech, sharing of illegal content, or engaging in any illegal activities.
Any content or conduct that violates these policies or the broader Mikeka AI Terms and Conditions may result in immediate action, including temporary suspension or permanent blocking from the Kijiwe Plus chatting system and potentially the entire Mikeka AI platform.
16. Reporting and Enforcement
To maintain a safe and positive environment, users have the ability to report instances of foul language, spamming, illegal activity, or any other violations of our policies. Upon receiving a report, Mikeka AI will investigate the matter. If a violation is confirmed, your account may be temporarily suspended or permanently blocked from using the Kijiwe Plus chatting system, and potentially from the entire Mikeka AI platform, at our sole discretion.
17. Data Security
We implement reasonable security measures to protect your chat data. However, no digital transmission or storage is entirely secure. You acknowledge this inherent risk when using the chat service.
18. User Content Ownership
You retain all ownership rights to the content you create and share through Kijiwe Plus. However, by posting content, you grant Mikeka AI a non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute that content solely for the purpose of operating and providing the Kijiwe Plus chat service.
19. Age Restrictions
Users of Kijiwe Plus must comply with the age requirements set forth in the main Mikeka AI Platform Terms and Conditions. Use by minors is prohibited.
20. Changes to this Policy
Mikeka AI reserves the right to update or modify this Kijiwe Plus Chat Policy at any time. We will notify users of significant changes, and your continued use of Kijiwe Plus after such modifications constitutes your acceptance of the updated policy.
